The Supreme Court of the United States (“SCOTUS”) recently struck down President Biden’s extension of the eviction moratorium that was implemented by the Centers for Disease Control and Prevention (“CDC”). In my view, the moratorium was certainly necessary to prevent the spread of the disease and to help Americans withstand the impact that COVID-19 had on our economy. However, now that the Pfizer vaccine has been fully approved by the FDA (and the likely approval of the Modern vaccine), the spread of COVID-19 is preventable for those 12 years old and over. Therefore, SCOTUS made the correct decision from both a legal perspective (i.e., “It is up to Congress, not the CDC, to decide whether the public interest merits further action here.”) and a public policy standpoint. It is time to let our economy stand on its own two feet again. Those tenants that are behind on rent must prepare for the expected wave of evictions that are expected now that the moratorium has come to an end. Dal Lago Law can help.
